RPM Fusion only ships software which is legally distributable (that's for
example why we don't ship flash-plugin or adobe reader, as their licenses don't
allow re-distribution). 

In the rubygem-passenger case only open-source licenses are involved. But that
doesn't make any difference at all afaics, as the different licenses in this
mixed form don't allow distribution of the product, hence *I*'d say we shozuld
not ship it.

That option is based on spot's comments. If he is wrong: Tell us. Or check how
other distributions (Debian would be a good example!) handle this package.
