Debian thinks this is non-free. :-(

(As I understand it, the offending paragraph is exactly the one I found
bizarrely worded too.)

For what it's worth, it's definitely GPL-incompatible (both FFmpeg and Libav
will refuse to use it without --enable-nonfree for that reason, see e.g.
