"Maybe" is not enough to invoke clause 8, they need to prove that there's
a
patent banning it in the US. Otherwise they're not compliant with the GPL and
thus their licensing is contradictory.
I have a high degree of confidence that there are Microsoft-held patents in the
US. If this came in without clause 8 today, I would still reject it.
