What I read at http://rpmfusion.org/Contributors#Your_package_gets_approved I understand it as it is the license of the content of the package that decides which repository to use. Winetricks itself is certainly free. You seem to add a rule saying approximately "a package that exclusively operates on proprietary software is put in the non-free repository, regarding of its own license". Or some more general version of that rule. Maybe it is intended that way. But if that is the case, I would certainly recommend clarifying the packaging guidelines referenced above.
